ContrastConnect has released a guide on the CMS’ definition of direct supervision and when virtual direct supervision is allowed.

-- ContrastConnect has published a guide outlining the Centers for Medicare & Medicaid Services’ (CMS) current definition of direct supervision. Administrators can refer to the resource to learn about revisions to federal guidelines, when virtual direct supervision is allowed, and how to ensure their facility is compliant for all modes of oversight.

Before January 1, direct supervision required supervisory personnel to be physically present and immediately available to assist with procedures in the office suite or department where the services were being performed. However, the public health emergency caused by the pandemic prompted the CMS to revise direct supervision rules to reduce the risk of disease transmission, temporarily allowing practitioners to remotely oversee diagnostic procedures through real-time audiovisual technology. These measures have now been made permanent, and facilities are permitted to implement virtual supervision into their operations, provided they follow compliance guidelines associated with the model.
Per ContrastConnect’s guide, virtual direct supervision requires real-time, two-way telecommunications technology that enables immediate communication between the supervising practitioner and staff members performing the service. Medical networks planning to operate with hybrid or fully remote supervision models must therefore ensure their facilities are equipped with telecommunications technology that enables secure and reliable connections; the practice must also have robust backup protocols for power outages. As with traditional direct supervision, virtual supervision must be documented rigorously with detailed records of any medical events, practitioner involvement, escalation procedures, and patient discharge records.
Virtual direct supervision can be provided for incident-to-services and certain diagnostic imaging tests, including ultrasound procedures, fluoroscopy, and laboratory tests of moderate complexity. For traditional direct supervision, ContrastConnect’s guide notes that specific healthcare settings may follow different guidelines; in physician offices, supervisory personnel must still be present in the same suite, while hospital outpatient departments only require practitioners to be immediately available within the campus or a provider-based department. While this creates complexities for healthcare organizations operating across multiple environments, ContrastConnect says that the onus is on providers to be aware of regulations to ensure their facilities remain compliant.
